1. Introduction

Welcome to Vitality.ae. These are the terms and conditions governing your access to and use of the website Vitality.ae and its related sub-domains, sites, social media platforms, services and tools (the "Site"). By accepting these terms and conditions (including the linked information herein), and by using the Site, you represent that you agree to comply with these terms and conditions with Vitality General Trading LLC ("we", "us" or "Vitality") in relation to your use of the Site (the "User Agreement"). This User Agreement is effective upon acceptance. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. By using the site, you agree with and accept this User Agreement and Vitality’s Privacy Policy (the "Privacy Policy"). You should read this User Agreement and the Privacy Policy and access and read all further linked information referred to in this User Agreement, as such information contains further terms and conditions that apply to you as a user of Vitality.ae. Such linked information including but not limited to the Privacy Policy is hereby incorporated by reference into this User Agreement.

2. Eligibility as a Customer

Vitality wishes to ensure that its Customers are able to form legally binding contracts and further that minors do not purchase unsuitable content. Therefore Customers of the Site is must be over the age of 18 years. You represent that you are 18 years of age or over the age of 18 years before you transact on the Site. Without prejudice to any other rights and remedies of Vitality under this User Agreement or at law, Vitality reserves the right to limit or withdraw access to the Site of any person if Vitality believes that person is under the age of 18 years. Further, if you are transacting as a business entity, you represent that you have the authority to bind that entity to this User Agreement and that you and the business entity will comply with all applicable laws relating to online trading. No person or business entity may register as a member of the Site more than once.

LIMITED LICENSE. You are granted a limited, non-exclusive, revocable and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Use. Vitality may change, suspend, or discontinue any aspect of the Site at any time. Vitality may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the Site. You shall have no rights to the proprietary software and related documentation, if any, provided to you in order to access the Site. Except as provided in the Terms of Use, you shall have no right to directly or indirectly, own, use, loan, sell, rent, lease, license, sublicense, assign, copy, translate, modify, adapt, improve, or create any new or derivative works from, or display, distribute, perform, or in any way exploit the Site, or any of its contents (including software) in whole or in part.


3. Your Site Usage Obligations
On using the Site, you agree: You are responsible for maintaining the confidentiality of, and restricting access to and use of any account(s) and password(s), and accept responsibility for all activities that occur under your account and password.
You agree to immediately notify Vitality of any unauthorised use of your password or account or any other breach of security.
In no event will Vitality be liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure of your personal or financial details.
You agree to reimburse Vitality for any improper, unauthorised or illegal use of your personal/financial details by you or by any person using the Site, services or otherwise, whether or not you authorised such access.
You will provide true, accurate, current and complete information about yourself as prompted by Vitality's registration form (the "Registration Data").
You will treat any other member's information provided to you (in accordance with these terms of use and the information on the Site) by Vitality or any other user as confidential.
If you provide any information that is untrue, inaccurate, not current or incomplete or if Vitality has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this User Agreement, without prejudice to any other rights and remedies of Vitality under this User Agreement or at law, Vitality has the right to indefinitely suspend, limit or withdraw your access to the Site and/or your usage of the Site.
Vitality may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that you provide it with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. Without limiting the foregoing, if you are a business entity or registered on behalf of a business entity such information or documentation may include your trade license, other incorporation documents and/or documentation showing any person's authority to act on your behalf. You agree to provide any information and/or documentation to Vitality upon such requests. You acknowledge and agree that if you do not, Vitality without liability may limit, suspend or restrict your access to the Site. We also reserve the right to cancel unconfirmed / unverified accounts or accounts that have been inactive for a long time.

The Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain Vitality’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. Vitality will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

4. Electronic Communications

You agree that we may communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Vitality requires your agreement during the registration process to send you promotional emails to let you know about any new changes, features or promotional activities added to the Site. If, at any time, you decide that you do not wish to receive promotional emails, you can opt out of receiving such promotional emails by clicking on the link at the bottom of any promotional email.

5. Amendments to this User Agreement
You acknowledge and agree that Vitality shall endeavour to give you notice for any amendment to this User Agreement that materially increases your obligations or decreases your rights under the User Agreement ("Substantial Amendment") in accordance with the terms of this User Agreement. You acknowledge and agree that Vitality at its sole discretion and without liability may make amendments that are not Substantial Amendments without your further specific agreement at any time with immediate effect by posting a notice of the amendment on the Site.

6. Fees and Services
Vitality is not an auction house nor a bank, and does not offer auction or banking services. The Site is an online platform allowing for the sale and purchase of items between Vitality and buyers.
Usage of the Site is free. Vitality does not charge any fee for browsing on the Site.
Vitality may choose to temporarily change the price offered for products for promotional events (for example, free shipping days) or new services, and such temporary changes are effective in accordance with their terms when we post them on the Site.

7. COD Payments
By providing COD payment facilities, Vitality is merely facilitating the making of online payments by buyers possible. Vitality is not responsible for collecting the payment from the buyer, this service is performed by a third party, usually the courier company. If any claim or dispute relating to, or arising out of a COD transaction arises, the onus will be on the buyer to provide evidence that they paid the collecting party. Vitality stronger recommends that all Customers ask for and retain receipts provided by the COD collecting party.

8. Your Information

You grant Vitality a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to use any information or material, personal or otherwise, that you provide to us or other users of the Site and/or post on the Site in the registration, usage or buying process, in the feedback area or through any e-mail or by way of any other feature or use of the Site (the "Information") for the purposes of operating and promoting the Site in accordance with this User Agreement and the Privacy Policy . You are solely responsible for the Information, and we act as a passive conduit for your online distribution and publication of the Information.

9. Use of the Site
While using the Site, you will not:
post Information or content in an inappropriate category or areas on our Site;
post items you do not have a right to link to or include;
post Information that is (in our sole discretion) false, fraudulent, inaccurate, misleading, libellous, defamatory, slanderous, unlawfully threatening or would be reasonably considered to constitute harassment;
post comments, questions or answers that are not factual in nature including without limitation make any racist comments, use profanity, abuse another user, disrespect another's culture or make any other derogatory or inappropriate comments;
post Information or items which infringe any third party's intellectual property rights, other proprietary rights or right to privacy;
post obscene Information or content, including but not limited to pornography or any representation which may (in our sole discretion) be considered indecent;
post Information or content which may (in our sole discretion) constitute offensive or critical political content or content that is contrary to the public interest;
post any Information or content which may (in our sole discretion) be considered culturally or religiously offensive in any way;
post any Information or content which (in our sole discretion) may not be considered to be in compliance with general Islamic Shariah law, rules, morals, values, ethics and traditions;
post Information or content which may (in our sole discretion) threaten national security;
post Information or content which may (in our sole discretion) constitute or be considered to promote gambling;
fail to deliver payment for items purchased by you, unless a clear typographical error is made;
use contacts made on the Site to solicit (including by email or otherwise) sales on other items directly and/or from another website;
claim an item was not sold when in Vitality's sole discretion the item was sold in accordance with this User Agreement and the Site's policies;
manipulate or attempt to manipulate the Site in any way including the prices of any item or services on the Site (either alone or in conjunction with other users);
circumvent or manipulate the billing process, or fees owed to Vitality;
take any action that may undermine the Site's feedback and ratings systems (including but not limited to the display, import or export of feedback information off the Site or use of such information for purposes unrelated to Vitality);
transfer your Site usage history (including feedback) to another party without our consent;
distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes;
distribute viruses, Trojan horses, worms, time bombs, cancelbots, Easter eggs or other computer programming technologies that may harm the Site, or the interests or property of the Site's users;
create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure; interfere or attempt to interfere with the proper working of the Site;
attempt to carry out any hacking or phishing of the Site or users accounts and related features;
export or re-export any Site tools except in compliance with the export control laws of any relevant jurisdictions;
copy, modify, or distribute any content from the Site or otherwise infringe the Site's copyright material and/or trademarks in any way;
violate any laws, rules, regulations, guidelines, third party rights or our policies;
abuse Vitality's Shipping Policy, Vitality’s Warranty Policy, Vitality’s Return Policy or any of Vitality's other policies or terms and conditions posted on the Site from time to time;
directly or indirectly, offer, attempt to offer, trade in, attempt to trade in, or include descriptions or links to any items of a similar type marketed by Vitality;
use non-transferable vouchers.
You undertake, represent and warrant that:
you are 18 years of age or over the age of 18 years;
if you are a corporate representative, you have authority to bind the corporate entity;
you will inform Vitality of any postings, items or transactions which appear to be in violation of this User Agreement;
you shall comply with all applicable domestic and international laws and regulations regarding and relating to your use of the Site;
you will not disclose your contact details including but not limited to phone numbers, addresses, or email addresses anywhere on the Site including the feedback area, discussion forum or through any e-mail feature of the Site intended to bypass use of Vitality;
you will not use contact information provided to you during the course of a transaction on the Site to solicit additional sales offline or on another website;
you will not harvest or otherwise collect information about users, including but not limited to email addresses and other contact information;
and you will not disclose or publicise any personal information about users or otherwise access or use information about other users in a manner which (in our sole discretion) may constitute a breach of privacy and/or applicable laws.

The Site may automatically produce search results that reference and/or link to third party sites throughout the World Wide Web. Vitality has no control over these sites or the content within them. Vitality does not guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Vitality does not endorse the content of any third party site, nor does it make any representation or warranty about these sites, including that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Vitality for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, you may notify us at Customer_Support.
10. Copyright
All content included on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property and copyright work of either Vitality, its users, its content suppliers or its licensors and is protected by copyright, trademarks, patents or other intellectual property rights and laws. The compilation of the content on the Site is the exclusive property and copyright of Vitality and is protected by copyright, trademarks, patents or other intellectual property rights and laws.

11. Trademarks

"Vitality" and related logos, and other words and logos on the Site (including without limitation “Vitality.ae", “Vitality-ME” and “VitalityMeToday”) are either unregistered trademarks or registered trademarks of Vitality and are protected by international trademark and other intellectual property rights and laws. Vitality's trademarks may not be used in connection with any product or service that is not Vitality's nor in any manner that disparages or discredits Vitality. All other trademarks not owned by Vitality that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Vitality.

12. Abusing Vitality

Please report problems of any kind or violations of this User Agreement to Vitality. If you believe that your intellectual property rights have been violated, please notify Vitality. Without prejudice to any other rights and remedies of Vitality under this User Agreement or at law, Vitality may limit, suspend or withdraw a user's access to the Site and/or a user's membership of the Site or remove hosted content. Also Vitality can choose to take other technical and/or legal steps against users who create problems or possible legal liabilities of any kind, who infringe the intellectual property rights of third parties or who act inconsistently with this User Agreement or our policies.

13. Platform for Communication

The Site is only a platform for communication whereby users may meet and interact with one another for the purpose of discussing and purchasing items. Vitality is not and cannot be a party to or control in any manner any interaction or transaction between two users of the Site. You will not hold Vitality responsible for other users' content, actions, or inactions, or items or Information they list or post.
In particular:
Vitality is not responsible for unsatisfactory or delayed performance, losses, damages or delays as a result of items that are unavailable.
Vitality does not make any representation or warranty as to the attributes (including but not limited to identity) of any of its users.
The Site may include links to third party websites that are controlled by and maintained by others. Vitality cannot accept any responsibility for the materials or offers for goods or services featured on such websites and any link to such websites is not an endorsement of such websites or a warranty that such websites will be free of viruses or other such items of a destructive nature and you acknowledge and agree that Vitality is not responsible for the content or availability of any such sites. However you acknowledge and agree that you may not include links in any user-posted content on the Site.
Vitality shall independently agree upon the manner and terms and conditions of delivery, payment, and insurance with the buyer.
Vitality accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
Vitality is not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising directly or indirectly, out of your use of or your inability to use the Site.
You release and indemnify Vitality and/or any of its officers and representatives in respect of any claim, demand, dispute, cost, damage, liability or other consequence (direct or indirect) of any of the actions of the users of the Site and you specifically waive any claims that you may have in this behalf under any applicable law.

14. Undeliverable Items

Vitality and its affiliates shall have the right to discard, destroy, liquidate or resell and as it may deem appropriate any sold goods/Items within sixty (60) days after receipt by the Delivery Company in the event of those goods/Items are being returned/undelivered from the Buyers for any reason. This clause shall be considered as an explicit authorization to Vitality to destroy and/or liquated any of the items/goods mentioned above and shall be without any objection from the Buyers and without any liability to Vitality or requirement for Vitality to provide the Customer with a refund.
Furthermore, Vitality is also authorized to deduct any fees or costs that might be incurred through the disposition and/or liquidation of the above.

15. Privacy
Vitality takes reasonable measures (physical, organisational and technological) to safeguard against unauthorised access to your personally identifiable information and to safely store your personally identifiable information. However, the Internet is not a secure medium and the privacy of your personal information can never be guaranteed. Vitality has no control over the practices of third parties (e.g. website links to this Site or third parties who misrepresent themselves as you or someone else). You agree that Vitality may process your personal information that you provide to it for the purposes of providing the services on Vitality and for sending marketing communications to you, and that the Privacy Policy of this Site governs our collection, processing, use and any transfer of your personally identifiable information.

15.1 INFORMATION GATHERED BY www.vitality.ae. This is www.vitality.ae’s (“www.vitality.ae”) online privacy policy (“Policy”). This policy applies only to activities www.vitality.ae engages in on its website and does not apply to www.vitality.ae activities that are "offline" or unrelated to the website.

15.2 www.vitality.ae collects certain anonymous data regarding the usage of the website. This information does not personally identify users, by itself or in combination with other information, and is gathered to improve the performance of the website. The anonymous data collected by the www.vitality.ae website can include information such as the type of browser you are using, and the length of the visit to the website. You may also be asked to provide personally identifiable information on the www.vitality.ae website, which may include your name, address, telephone number and e-mail address. This information can be gathered when feedback or e-mails are sent to www.vitality.ae, when you register for services, or make purchases via the website. 15.3 COOKIES. Cookies are small bits of data cached in a user’s browser. www.vitality.ae utilizes cookies to determine whether or not you have visited the home page in the past. However, no other user information is gathered.

15.4 USE AND DISCLOSURE OF INFORMATION. Except as otherwise stated below, we do not sell, trade or rent your personally identifiable information collected on the site to others. The information collected by our site is used to process orders, to keep you informed about your order status, to notify you of products or special offers that may be of interest to you, and for statistical purposes for improving our site. We will disclose your personally identifiable information to third parties for order tracking purposes or process your check or money order, as appropriate, fill your order, improve the functionality of our site, perform statistical and data analyses deliver your order and deliver promotional emails to you from us. For example, we must release your mailing address information to the delivery service to deliver products that you ordered. All credit/debit cards’ details or and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties

15.5 www.vitality.ae may use non-personal "aggregated data" to enhance the operation of our website, or analyze interest in the areas of our website. Moreover, we may in some circumstances disclose personally identifiable information to third parties to enhance your experience on our website. Additionally, if you provide www.vitality.ae with content for publishing or feedback, we may publish your user name or other identifying data with your permission.

15.6 www.vitality.ae may also disclose personally identifiable information in order to respond to a subpoena, court order or other such request. www.vitality.ae may also provide such personally identifiable information in response to a law enforcement agencies request or as otherwise required by law. Your personally identifiable information may be provided to a party if www.vitality.ae files for bankruptcy, or there is a transfer of the assets or ownership of www.vitality.ae in connection with proposed or consummated corporate reorganizations, such as mergers or acquisitions.

15.7 OTHER WEBSITES. www.vitality.ae is not responsible for the privacy policies of websites to which it links. If you provide any information to such third parties different rules regarding the collection and use of your personal information may apply. We strongly suggest you review such third party’s privacy policies before providing any data to them. We are not responsible for the policies or practices of third parties. Please be aware that our sites may contain links to other sites on the Internet that are owned and operated by third parties. The information practices of those Web sites linked to our site is not covered by this Policy. These other sites may send their own cookies or clear GIFs to users, collect data or solicit personally identifiable information. We cannot control this collection of information. You should contact these entities directly if you have any questions about their use of the information that they collect.

15.8 SECURITY. www.vitality.ae takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, www.vitality.ae cannot guarantee the security of any information that is disclosed online.

15.9 MINORS. www.vitality.ae does not knowingly collect personal information from minors under the age of 18. Minors are not permitted to use the www.vitality.ae website or services, and www.vitality.ae requests that minors under the age of 18 not submit any personal information to the website. Since information regarding minors under the age of 18 is not collected, www.vitality.ae does not knowingly distribute personal information regarding minors under the age of 18.

15.10 CORRECTIONS AND UPDATES. If you wish to modify or update any information www.vitality.ae has received, please contact CUSTOMER_SUPPORT.

15.11 MODIFICATIONS OF THE PRIVACY POLICY. www.vitality.ae. The Website Policies and Terms & Conditions would be changed or updated occasionally to meet the requirements and standards. Customers will be notified about these changes as well as the Payment Gateway Provider / NBAD. Such modifications will become effective on the day they are posted. www.vitality.ae encourages you to frequently review the privacy policy for any modifications.

16. Breach of User Agreement

Without prejudice to any other rights and remedies of Vitality under this User Agreement or at law or otherwise, Vitality may immediately and without liability: limit your activity, warn other users of your actions, temporarily / indefinitely suspend access and/or limit or
withdraw your access to the Site:
If you breach this User Agreement;
If Vitality is unable to verify or authenticate any information you provide;
or If Vitality believes (in its sole discretion) that your actions may cause legal liability for you, other users or Vitality.
Vitality may at any time at its sole discretion reinstate suspended users. A user that has been indefinitely suspended or had their usage restricted may not register or attempt to use the Site in any manner whatsoever until such time that such user is reinstated by Vitality.
Notwithstanding the foregoing, if you breach this User Agreement Vitality reserves the right to recover any amounts due and owing by you to Vitality or any losses and damages caused by you to Vitality and to take such steps including legal action and/or the initiation of criminal proceedings against you as Vitality in its sole discretion deems necessary.
Our failure to act with respect to a breach by you or others does not constitute a waiver of Vitality's right to take any actions with respect to that, or subsequent or similar breaches. Vitality does not guarantee that it will take action against all breaches that there may be of this User Agreement.

17. Buying on the Site
Vitality's reserves the right to reject or void purchases. By purchasing an item you agree to be bound by the conditions of sale included by Vitality in the item's description on the Site (so long as those conditions of sale are not in violation of this User Agreement or are not in compliance with applicable laws).
Transactions through PayPal will be in U.S. Dollars.

Cash on Delivery (“COD”) transactions and all other payments will be in Arab Emirates Dirhams, unless otherwise stated or agreed in advance with Vitality.

Transactions by Visa or Mastercard debit and credit cards will be in AED for its products and services. Vitality may also accept payment in multi-currency priced transactions. Where applicable, the displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.

All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorised officer of Vitality. All refunds will be made onto the original mode of payment.

Vitality reserves the right to take any necessary steps including legal action in case of non-payment of goods by you to Vitality and in instances such as disputes where goods have not be returned in unopened, unused and in the original condition as sold. Other instances include non-payment where cheques cannot be presented or accepted by the bank, utilisation of fraudulent payment methods or credit card chargebacks.

After an order is placed, you will receive an acknowledgement email detailing the items ordered will be sent to you. This is not an acceptance of the sale on the behalf of Vitality.

Vitality will confirm acceptance of the sale of the selected items to you at the price specified at checkout when you receive an email confirming dispatch of your order, unless we have subsequently notified and agreed otherwise.

You must notify Vitality if they wish to cancel their order before products are dispatched. Such cancellations will be subject to the
Cancellation/Refund/Return Policy.

Vitality does not guarantee that every item displayed on
the Site is available at the listed price. If the price differs, Vitality is not obligated to sell the item at the listed price. We will make every effort to contact you if you offered to purchase a product that it is no longer available at the displayed price. If the sell price of the item is higher than the listed/checkout price, then you may cancel the order. The order will be cancelled and will be subject to the Cancellation/Refund/Return Policy.

Vitality will always do our best to ensure sufficient stock is on hand, however we cannot guarantee that all items displayed on the Site are in stock and available for delivery. Should this be the case at the time your order is placed, you will be notified of an alternative date for delivery. Alternatively, you may cancel your order which will be subject to the
Cancellation/Refund/Return Policy.

Vitality will always do our best to ensure that items are presented with clear and accurate details. Vitality is not liable for the accuracy or completeness of the product descriptions or the photographs of products, featured product reviews or comments from other users of the Site. If you believe that the product does not match the stated description or photograph once receiving it, your sole remedy is to return it in accordance with the
Cancellation/Refund/Return Policy, in an unused condition in the original packaging at your own cost.

If Vitality does not accept to sell you the products you selected at checkout, we will notify you of such decision before dispatching. We reserve the right to refuse a sale at our sole discretion which will be subject to the
Cancellation/Refund/Return Policy, however non acceptance of the sale on behalf of Vitality will usually take place for one or more of the following reasons: 

    We do not take any responsibility for the time it takes to process any payment.

    Vitality is not liable for any additional customs, duties or similar charges outside of the UAE. If you are buying from outside the UAE, please refer to your local customs department to estimate the additional cost to you for importing the product into your home country.

    As a buyer on the Site we encourage you to post feedback for other buyers to assist them with their purchase decision.

    You agree not to test the Site with false purchases, nor to use a false name, other false personal information or use an unauthorised or known invalid credit card or other payments methods to Purchase.

    Without prejudice to the rights and remedies available to Vitality under this User Agreement or at law, Vitality may take such steps as it deems appropriate or necessary including taking legal action against users who intentionally enter erroneous, fictitious or fraudulent Purchase information. Please be aware that even if you do not give Vitality your real name, your web browser transmits a unique address to us, which can be used by law enforcement officials to identify you.

    Without limiting any rights or remedies available to Vitality under this User Agreement or at law, Vitality may suspend, limit or withdraw your access to the Site if you are found to have engaged in false or fraudulent activity in connection with the use of the Site.

    You acknowledge and agree that Vitality has the right to use your registration data for this purpose of corresponding with you and that Vitality is not responsible for the accuracy or otherwise of any data entered by the user during the checkout process or in correspondence or otherwise.

    18. Delivery and Shipping

    The assigned delivery time for your item cannot be guaranteed. If we miss you the first time we will try to re-deliver at least one more time.     We accept no liability for items once they are dispatched and are in the possession of our shipping partners. Once the order is dispatched, the sale is considered to be complete and the risk of loss is passed onto yourself.

    Vitality provides you with the option to request a full or partial order cancellation if Vitality has taken payment and:
      The refund value will be calculated as the Original order value of the item affected.
      You can expect to receive your refund within 10 business days after notifying Vitality of your decision to cancel your order. In many cases, you will receive a refund sooner; however, we estimate 10 business days because of the time required to process the refund (up to 5 business days) and for processing from your bank or credit card company (up to 5 business days). We will issue your refund using the same payment method as the original purchase. If you made the original purchase in cash, you will be required to provide UAE bank details in order to process the refund.

      Cancellation – Before shipping
      You may initiate a return for a full refund of an item before we notify that your item has been dispatched, minus any administration/processing fees.
      How to initiate a cancellation and refund:
        The refund value will be calculated as follows:

        minus an administration/processing fee of 20% of the original order value.
        You can expect to receive your refund within 10 business days after notifying Vitality of your decision to cancel your order.         Unsuccessful Delivery – Refused/Incorrect Address/Not available
        Vitality shipping partners will attempt a minimum of two deliveries. If for any reason Vitality is unable to deliver your order to you after two attempts, your order will be either left at a local depot for you to collect or returned to Vitality for re-stocking.
        If returned to Vitality, you will be notified by our customer service team. You may request a refund or re-delivery.
        How to initiate a re-delivery:
          There will be no additional charges if the error arose due to Vitality or Vitality’s shipping partner.
          If the non-delivery was the result of your error or actions, then a re-delivery charge will apply, which needs to be paid before your order is dispatched.
          How to initiate a refund:
            The refund value will be calculated as follows:
            Original Order Value of items returned
            minus an administration/processing fee of 20% of the original order value.

            Non-Warranty Returns – Incorrect Choice / Change of Mind after Delivery
            You may initiate a return for a full refund of an item within 3 calendar days of the item being delivered, minus shipping charges, restocking, customs/duties or other fees.
            Refunds will be only provided for items need to be UNUSED and UNOPENED. By initiating a return, you provide a warranty and undertaking that the items are UNUSED and UNOPENED.
            How to initiate a return and refund:
                We must receive you the item you wish to return within 7 working days of receiving from your request days of delivery.
                Failure to provide all materials included in the shipment in the required condition or ensuring the items packaging is not protected for the return shipment will cause a delay in or a refusal of your refund request.

We will issue your refund using the same payment method as the original purchase.                   20. Providing Feedback
                  Vitality encourages feedback on the Site as it helps other buyers in their purchase decision. Your feedback will be displayed along with your email address or other appropriate identification standard on the Site. You cannot retract the feedback once you have left it. Vitality will not be responsible or liable in any way for the feedback that you post on the Site. You agree not to make comments that are not factual in nature including without limitation making any racist comments, using profanity, abusing another user, disrespecting another culture or any other derogatory or inappropriate comments. You further agree not to post feedback in order to solicit sales outside of the Site and not to display contact information of any person within any feedback.
                  Without prejudice to any other rights and remedies of Vitality under this User Agreement or at law, Vitality reserves the right to suspend, limit or withdraw your access to the Site. As feedback ratings are not designed for any purpose other than for facilitating purchase decisions, you agree that you shall not market or export Vitality feedback in any venue other than on the Site. Vitality does not provide the technical ability to allow you to import feedback from other websites to the Site.

                  21. Withdrawal of Access
                  Without prejudice to any other rights and remedies of Vitality under this User Agreement or at law or otherwise, Vitality may limit, suspend or block your access to the Site at any time, without notice, for any reason, including without limitation, breach of this User Agreement.

                  Vitality provides the Site and its services on an "as is" and "as available" basis without any representation or endorsement made and without any warranty or guarantee of any kind whether express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, compatibility, security, accuracy and non-infringement. Vitality makes no representations or warranties about the accuracy, reliability, or completeness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted. Vitality makes no warranty that defects will be corrected or that the Site or its servers are free of viruses or anything else which may be harmful or destructive. The nature of Internet communications means that this Site may be susceptible to data corruption, interception, non-availability and delays. The Site may also be unavailable from time to time due to repairs, maintenance or development work. You agree that Vitality has no obligation to provide support for the Site.                   23. Limitation of Liabilities
                  To the extent permitted by law, Vitality, its officers, employees, agents, affiliates and suppliers shall not be liable for any loss or damage whatsoever whether direct, indirect, incidental, special, consequential or exemplary, including but not limited to, losses or damages for loss of profits, goodwill, business, opportunity, data or other intangible losses arising out of or in connection with your use of the Site, its services or this User Agreement (however arising, including negligence or otherwise and whether or not Vitality has been advised of the possibility of such losses or damages). If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorised use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to Vitality and Vitality shall treat any such unauthorised use as subject to the terms and conditions of this User Agreement.

                  24. Indemnity
                  You agree to indemnify and hold Vitality and its affiliates, officers, employees, agents and suppliers harmless from any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred due to or arising out of your breach of this User Agreement, or your violation of any law or the rights of a third party.

                  25. Relationship and Notice

                  None of the provisions of this User Agreement shall be deemed to constitute a partnership or agency between you and Vitality and you shall have no authority to bind Vitality in any manner whatsoever.
                  Except as explicitly stated otherwise, any notices to Vitality from you shall be given by you by email to Vitality at legal@Vitality with a physical copy sent to us by mail or courier, such notice deemed given on confirmation of its receipt to you by Vitality by return email. Any notices to you from Vitality shall be given by notices posted on the Site or by email to the email address you have provided and shall be deemed to be received by you 48 hours after any such email is sent. Alternatively, we may give you notice by mail or prepaid shipping to the address provided to us during the registration process. In such case, notice shall be deemed given 7 days after the date of mailing.

                  26. Disputes

                  If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) ("Dispute") arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute.
                  In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day-period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out below, under the Arbitration Rules of the Dubai International Financial Centre - London Court of International Arbitration ("LCIA"), which rules ("Rules") are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The parties to the arbitration shall seek to agree on a sole arbitrator to be nominated to the LCIA court for appointment. If the parties to the arbitration fail to nominate a sole arbitrator within 30 days from the date of the service of the request upon the respondent (or such greater or lesser period as may be fixed by the LCIA Court), the sole arbitrator shall be appointed by the LCIA Court. The seat or legal place of the arbitration shall be Dubai International Financial Centre in Dubai, UAE. The arbitration proceedings shall be conducted in the English language and the award shall be in English. The foregoing provisions of this clause are
                  without prejudice to the right of Vitality to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and Vitality shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so.

                  27. Transfer of Rights and Obligations

                  You hereby grant Vitality the right to, and irrevocably acknowledge and agree that Vitality may at any time, transfer all or any part of its rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement to any of its affiliates without requiring your further specific agreement. Vitality agrees to use all reasonable endeavours to provide notice to you of any transfer by way of a posting on the Site. You may not at any time, without the prior written consent of Vitality, transfer all or any part of your rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement without the prior written consent of Vitality.

                  28. General

                  If any clause of this User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of this User Agreement. This User Agreement (as amended from time to time in accordance with the terms of this User Agreement) sets forth the entire understanding and agreement between you and Vitality with respect to the subject matter hereof.
                  No person who is not a party to this User Agreement shall have any right to enforce any term of this User Agreement. If this User Agreement is translated into any language other than English, whether on the Site or otherwise, the English text shall prevail.

                  29. Warranty conditions – 7 year Warranty
                  Product Registration
                  Vitality and Vita-Mix Corporation ("Vitamix") strongly encourages you to register your purchase by completing and returning the product registration card that came with this Machine. You can register online at www.vitamix.com/warranty. Failure to register your product purchase will not diminish your warranty rights. However, registering your purchase will allow Vitamix to better serve you with any of your customer service needs.
                  Warranty Coverage
                  This Warranty is extended by Vitamix and Vitality to the owner of this Machine for personal household use only. This Warranty does not apply to products used for commercial, rental or re-sale purposes. Should ownership of the machine change during the 7-year period, please update the Machine's owner information at www.vitamix.com/warranty.
                  What is Covered
                  Vitamix and Vitality warrants to the owner that if this Machine (a "Machine" consists of a motor blender base and any containers purchased together) fails within 7 years from the date of purchase due to a defect in material or workmanship or as a result of normal wear and tear from ordinary household use, Vitamix and Vitality will, within 45 days of receipt of the returned product, repair the failed Machine or component part of the Machine free of charge.
                  If, in Vitamix's or Vitality’s sole discretion, the failed Machine or component part of the Machine cannot be repaired, Vitamix or Vitality will elect to either:
                  (A) replace the Machine free of charge; or
                  (B) refund the full purchase price to the owner, unless Vitamix or Vitality receives
                  prior written notice of the owner's preference.
                  What is Not Covered
                  This Warranty does not apply to Machines that have been used commercially or in non-household applications. This Warranty does not cover cosmetic changes that do not affect performance, such as discoloration or the effects of the use of abrasives or cleaners or food build up. This Warranty is only valid if the Machine is used and maintained in accordance with the instructions, warnings and safeguards contained in the owner's manual.
                  What voids the Warranty
                  Abuse, misuse, negligent use, alteration of the Machine, exposure to abnormal or extreme conditions, or failure to follow the operating instructions will void this Warranty. The Warranty is also void if repairs to the Machine or any component part of the Machine are performed by someone other than either Vitamix or Vitality or an authorized Vitamix Service Provider or if any component part of a Machine subject to this Warranty is used in combination with a motor-base or container that is not expressly authorized by Vitamix or Vitality.
                  Vitamix or Vitality will not be responsible for the cost of any unauthorized warranty repairs.
                  How to Obtain Return Authorization Under This Warranty.
                  In the event that the Machine or any component part of the Machine needs service or repair, please call Vitality Customer Service at +971 (0)4 456 1123. You will be asked to provide a date of purchase and proof of purchase for any product that has not been registered with Vitamix. For product subject to this Warranty you will be provided with a return authorization number, up-to-date shipping instructions and a pre-paid return pick up label.
                  You will be deemed to have accepted the returned product "as is" upon delivery unless you notify Vitamix or Vitality of any problem, including shipment damage, within 48 hours of delivery.
                  Purchaser is responsible for the costs, taxes, duties and other fees of shipping to the nearest Authorised Vitamix Service Centre, which may be located in Europe or the UK. Email

                  Repair or replacement under the terms of this warranty does not provide right to extension or renewal of the warranty period.
                  The warranty does not cover the following:
                  Periodic checks, maintenance, repair and replacement of parts due to normal wear and tear or the replacement of consumables.
                  Abuse or misuse, including but not solely limited to the failure to use this product for its normal purposes or in accordance with Vitality's or Vitamix instructions on usage and maintenance. Defects resulting from usage of the product in conjunction with accessories that are not approved by Vitality or Vitamix for use with this product.
                  Failure of the product arising from incorrect installation or use not consistent with the instructions and technical or safety standards prescribed in the product user manual. Accidents, Acts of God, lightning, water, fire, public disturbances, improper ventilation, voltage fluctuations or any cause beyond the control of Vitality or Vitamix.
                  Unauthorized modifications carried out to the product in order to comply with local or international technical standards in countries for which this Vitamix product was not originally designed.
                  The Serial number on the product has been altered, deleted, removed or made illegible.
                  Any of the seals on the appliance enclosure show evidence of tampering.
                  REPAIR, REPLACEMENT OR REFUND OF THE PURCHASE PRICE ARE THE EXCLUSIVE REMEDIES OF PURCHASER AND THE SOLE LIABILITY OF VITAMIX OR VITALITY UNDER THIS WARRANTY. NO EMPLOYEE OR REPRESENTATIVE OF VITAMIX OR VITALITY IS AUTHORIZED TO MAKE ANY ADDITIONAL WARRANTY OR ANY MODIFICATION TO THIS WARRANTY WHICH MAY BE BINDING UPON VITAMIX OR VITALITY. ACCORDINGLY, PURCHASER SHOULD NOT RELY UPON ANY ADDITIONAL STATEMENTS MADE BY ANY EMPLOYEE OR REPRESENTATIVE OF VITAMIX OR VITALITY. IN NO EVENT, WHETHER BASED ON CONTRACT, INDEMNITY, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, SHALL VITAMIX BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFIT OR REVENUE.

                  30. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES
                  Vitality will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country-specific.

                  31. Site Operation

                  Vitality controls this Site from the U.A.E. Vitality makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws.
